Dear Judge San Martín Castro,
I write to you about the case of Yuri, an 8
year old girl who was raped and murdered on December 18, 2003 in Huánuco, Peru.
I am concerned that her case be fairly considered by the court, without delay,
and that she and her family receive justice.
As you are aware, there have been numerous
irregularities in how Yuri’s rape and murder have been investigated and
prosecuted – from the payment of bribes and lengthy delays to evidence being destroyed
or lost. Indeed, the persons who destroyed the evidence have been tried,
convicted and sentenced for their attempt to cover up the crime and impede the
prosecution. Despite the destruction of evidence, however, there is ample and
clear evidence in the record to show that a crime has been committed.
These attempts to deny justice to Yuri and her
family are not worthy of a legal system that should protect all citizens,
regardless of status, in particular those who are the most vulnerable and
defenseless. Yuri’s case represents all those in Peru who have little or no
access to justice.
I commend the service you provide to your
country and community as you administer justice in difficult cases. As a
representative of the court in Peru, I urge you to uphold and exemplify a tradition of excellence,
professionalism, and service to those who most need it. I respectfully request that
this court ensure that Yuri’s case is fairly and objectively heard, without
delay, and that all the evidence is considered. I will continue to monitor the
progress of Yuri’s case along with others.
